Diversity and Anti-Discrimination Policy
This policy aims to provide a clear statement of the commitment of NICH Real Estate to promoting an inclusive and diverse environment, free from discrimination and harassment, for all stakeholders, including employees, clients, buyers, tenants, contractors, and suppliers. This policy ensures compliance with the Equal Opportunity Act 1984, Disability Discrimination Act 1992, Racial Discrimination Act 1975, Sex Discrimination Act 1984, Privacy Act 1988, and other relevant legislation.
This policy applies to all employees, clients, buyers, tenants, contractors, suppliers, and job applicants within NICH Real Estate.
NICH Real Estate is committed to creating an environment where all individuals are treated with respect, dignity, and fairness. Discrimination, harassment, and bullying based on any characteristic covered by law are prohibited, including but not limited to:

Definitions
• Diversity: The recognition and respect of differences, including but not limited to race, ethnicity, gender, age, sexual orientation, disability, religion, and cultural background.
• Inclusion: Creating an environment where everyone feels welcomed, valued, and respected, enabling them to fully participate and contribute to the organization’s success.
Legislation
Equal Opportunity Act 1984 (SA): This Act aims to eliminate discrimination and promote equality of opportunity in various areas, including employment, education, and provision of goods and services.
Racial Vilification Act 1996 (SA): This Act makes it unlawful to incite or engage in racial vilification, promoting a respectful and inclusive environment.
Disability Discrimination Act 1992 (Cth): While a Commonwealth Act, it applies to South Australia and prohibits discrimination against people with disabilities in various areas, including employment.
Sex Discrimination Act 1984 (Cth): Another Commonwealth Act that applies to South Australia, prohibiting discrimination on the basis of sex, sexual orientation, gender identity, intersex status, marital or relationship status, pregnancy, or potential pregnancy.
Fair Work Act 2009 (Cth): This Act provides a framework for fair work practices, including protections against workplace discrimination and harassment.
Additionally, we are committed to protecting the privacy of all personal information in accordance with the Privacy Act 1988. We will collect, use, store, and disclose personal information in a manner that is lawful, fair, and transparent.
Discrimination: Unfair treatment based on certain characteristics such as age, disability, gender, race, religion, or sexual orientation.
Harassment: Unwelcome behaviour that humiliates, offends, or intimidates a person.
Bullying: Repeated, unreasonable behaviour directed towards an individual or group that creates a risk to health and safety.
Personal Information: Any information that can identify an individual, as defined by the Privacy Act 1988.
Responsibilities
Management: Ensure adherence to this policy, provide training, and address any complaints promptly. Employees: Treat others with respect, report any discrimination, harassment, or privacy concerns, and comply with the policy.
Clients, Buyers, Tenants, Contractors, and Suppliers: Expected to adhere to the principles of this policy when interacting with our agency and its employees.
Procedure for Addressing Discrimination, Harassment, and Privacy Concerns.
Informal Resolution:
o The aggrieved party is encouraged to address the issue directly with the person involved, if they feel comfortable doing so.
o If the issue is resolved informally, no further action is required.
o If the issue is not resolved informally or if the aggrieved party prefers, they may submit a formal complaint.
o Complaints should be submitted in writing to the Human Resources department or a designated officer, detailing the nature of the complaint, the individuals involved, and any relevant evidence.
Confidentiality and Non-Retaliation
All complaints will be treated confidentially. Retaliation against any individual who files a complaint or participates in an investigation is strictly prohibited.
Privacy and Data Protection
NICH Real Estate will handle all personal information in compliance with the Privacy Act 1988. We will take reasonable steps to protect personal information from misuse, loss, unauthorised access, modification, or disclosure.
